2. LICENSED STREAMING

Bean Internet Radio 90s Hits operates as a licensed internet radio station through the Live365 platform. Our streaming activities are conducted under Live365's statutory licensing arrangements, which have been established in compliance with applicable U.S. copyright law.

Live365 pays statutory royalties to SoundExchange on behalf of stations operating on its platform. These royalties cover sound recording royalties for featured artists, non-featured musicians, and copyright owners of the master recordings played on our station.

Royalties for musical compositions (i.e., the underlying songs, including melody and lyrics) are similarly managed through Live365's licensing arrangements with applicable performing rights organizations and mechanical licensing bodies.

3. USER-GENERATED CONTENT AND WEBSITE CONTENT

Our website, beaninternetradio.net, may include user-submitted content such as song requests, listener comments, or general feedback submitted through available forms or interactive features on the site.

We do not host or store third-party copyrighted material on our website outside of what is covered by our Live365 streaming license. Any content submitted by users that is found to infringe upon third-party intellectual property rights will be addressed in accordance with this DMCA Policy.

This DMCA Policy primarily governs content hosted directly on the station website. It does not govern the streamed music content itself, which is subject to Live365's own terms, licenses, and DMCA compliance procedures (see Section 7 below).

Warning — Misrepresentation and False Claims

Submitting a false, fraudulent, or materially misleading DMCA takedown notice may expose you to significant legal liability, including liability for damages — such as costs and attorneys' fees — incurred by the alleged infringer or service provider, pursuant to 17 U.S.C. § 512(f).

 

 

5. COUNTER-NOTIFICATION PROCEDURE

If you believe that content was removed from our website in error or as a result of misidentification, you may submit a Counter-Notification in accordance with 17 U.S.C. § 512(g).   4. Your full name, mailing address, and telephone number; and

  5. A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is located outside of the United States, any judicial district in which Bean Internet Radio 90s Hits may be found), and that you will accept service of process from the person who provided the original notification of alleged infringement or an agent of such person.

Upon receipt of a valid and complete counter-notification, we will forward a copy to the original complainant and inform them that we may restore the removed content or cease disabling access to it after 10–14 business days, unless the original complainant files a court action seeking to restrain the alleged infringing activity and notifies us accordingly.

 

6. REPEAT INFRINGER POLICY

In accordance with the Digital Millennium Copyright Act and applicable U.S. copyright law, Bean Internet Radio 90s Hits has adopted and implemented a policy for the termination of services for users who are determined to be repeat copyright infringers.
